Agreement and Acknowledgment of Risk:
I, the undersigned, understand and acknowledge that my participation in activities at Cold Tub Coffee Club, including but not limited to the use of cold plunge tubs and consumption of beverages, involves inherent risks that may result in personal injury, illness, or other harm. These risks include, but are not limited to, exposure to cold water, temperature shock, slips and falls, physical exertion, adverse reactions to caffeine, and other unforeseen risks associated with the facilities and services provided.
I acknowledge that I am in good health, physically fit, and capable of safely participating in the activities provided by Cold Tub Coffee Club. I understand that it is my responsibility to consult with a physician before participating in any activities that may impact my health or well-being.
Release of Liability:
In consideration of being permitted to participate in activities at Cold Tub Coffee Club, I hereby release, waive, discharge, and hold harmless Cold Tub Coffee Club, its owners, employees, agents, and affiliates from any and all liability, claims, demands, actions, or causes of action arising out of or related to any loss, damage, or injury, including death, that may be sustained by me or my property while participating in any activities at Cold Tub Coffee Club.
Indemnification:
I agree to indemnify and hold harmless Cold Tub Coffee Club, its owners, employees, agents, and affiliates from any and all claims, actions, suits, procedures, costs, expenses, damages, and liabilities, including attorney’s fees, brought as a result of my involvement in activities at Cold Tub Coffee Club and to reimburse them for any such expenses incurred.
Medical Treatment:
I consent to receive any necessary medical treatment that may be deemed advisable in the event of injury, accident, or illness during my participation in activities at Cold Tub Coffee Club. I agree to be responsible for any medical expenses incurred.
Assumption of Risk:
I have read this waiver and fully understand its terms. I acknowledge that I am signing this waiver freely and voluntarily, and intend by my signature to be a complete and unconditional release of all liability to the greatest extent allowed by law.
